ORDER
This petition has been filed seeking direction to the respondents 1 to 4 to provide Police protection to the petitioner's business premises and to prevent the counter-petitioners from causing damage to the property situated at S.Nos.1467/1, 1468, 1509/1, 1512/2, Vellore.
2.The petitioner, who is the Branch Manager of M/s.Pachaiyappas Silks Private Ltd., states that the company has been in the silk retail business for over a hundred years. In 2013, the petitioner opened a showroom in Vellore, situated at S.Nos.1467/1, 1468, 1509/1, 1512/2. It is alleged that the respondents 5 to 8 forcibly entering the property, causing damage to the premises and the vehicles parked therein. When the same was questioned, the respondents 5 to 8
reportedly abused and threatened the petitioners and the customers. They allegedly entered the show room without permission, consumed alcohol and broke glass fixtures. Although a complaint was lodged, and C.S.R.No.0307 of 2025 was assigned on 11.04.2026, the petitioner contends that no action has been taken.
3.The learned Additional Public Prosecutor submitted that following the petitioner's complaint, an enquiry was conducted under C.S.R.No.0307 of 2025. The counter petitioners namely Panneer, Murugan, Anbu, Ramesh have asserted rights over the property, indicating a dispute regarding the survey boundaries. While a surveyor has submitted a report, the police are currently coordinating with the Tahsildar to verify the actual extent of the land and the respective rights of the parties. He further submitted that the enquiry will be completed within two months. If the petitioner is found to be in rightful possession, appropriate steps will be taken to ensure no damage is caused by the miscreants or any other claimants.
4.Heard the learned counsels on either side and perused the materials available on record.
5.Considering the submissions, this Court passes the following directions: i)The 2nd respondent is directed to conclude the enquiry in C.S.R. No. 0307 of 2025 within a period of two months from the date of receipt of copy of this order, after hearing both the petitioner and the counter-petitioners. ii)Pending the outcome of the enquiry, the respondent police shall ensure that no law and order problem is created at the site. iii)If any immediate act of violence, trespass, or damage to property is reported by the petitioner, the respondent police shall provide necessary protection to prevent any untoward incident, without prejudice to the civil rights of either party.
6.With the above directions, this Petition is disposed of. No costs. Consequently, connected miscellaneous Petition is closed. 29-04-2026 ep
