..Respondent(s) Prayer: This writ petition is filed under Article 226 of the Constitution of India for issuance of a writ of mandamus directing the respondents to reckon the calculation with 12% of Dearness Allowance as ordered in G.O.Ms.No.247, dated 13.11.2025, for settlement of service gratuity and leave salary and to pay the monetary value of 3 percentage of increased dearness allowance with 6% interest per annum form the date of retirement, in the light of Judgment passed by this Court on 25.08.2022 in W.P.No.14421 of 2022.

ORDER

The relief sought for in the writ petition is for a direction to the respondents to pay the monetary value of 3% of increased dearness allowance along with interest as per G.O. Ms. No.247 Finance (Allowances) Department dated 13.11.2025.

2. It is the case of the petitioner that the petitioner was appointed in the respondent Transport Corporation on 08.04.1994 and retired from service as Senior Tradesman on 31.07.2025. To the shock and surmise of the petitioner, the respondent Corporation has settled the terminal benefits with a delay by fixing Dearness Allowance at 55% on the basis of earlier G.O. As per G.O.Ms.No.247, Finance (Allowances) Department dated 13.11.2025, the Dearness Allowance ought to have been fixed at 58%. Hence, the petitioner submitted a representation dated 13.03.2026 before the respondents seeking to pay him the monetary value of 3% increased dearness allowance along with interest at the rate of 6% per annum from the date of his retirement to till date. However, the same has not been considered. Hence, the petitioner is before this Court.

The learned counsel appearing for the petitioner has submitted that this Court has considered the writ petition in W.P.No.14421 of 2022 filed by the similar placed person and by order dated 25.08.2022, directed the respondents to pay difference amount of increased Dearness Allowance by adopting the earlier order of this Court in W.P.Nos. 20773 of 2017, dated 19.02.2019 and the orders of the Government in G.O.Ms.No.154 Finance (Pension) Department dated 20.05.2019 and directed the respondent to pay interest at the rate of 4% per annum for the belated payments. Therefore the petitioner herein is also entitled for the benefit of monetary value of 3% increase in Dearness Allowance.

4. Heard the learned counsel appearing on either side and perused the materials available on record.

Considering the facts and circumstances of the case, this Court directs the respondents to consider the petitioner's representation dated 13.03.2026 and pay the monetary value of 3% increase in Dearness Allowance as per Rules and in the light of the orders passed by this Court in W.P.No.14221 of 2022, dated 25.08.2022 and the orders of the Government in G.O.Ms.No.247 Finance (Allowances) Department dated 13.11.2025, as expeditiously as possible, within a period of twelve (12) weeks from the date of receipt of a copy of this order. The respondents shall pay the interest at the rate of 4% per annum for the

belated payment.

6. With the above directions, the writ petition stands disposed of. No costs.
