E.A.No.28 of 2024 in C.C.No.171 of 2017 on the file of the State Consumer Disputes Redressal Commission, Chennai, issued to the second respondent through the first respondent and to comply with the conditions therein, by directing the first respondent to issue the warrant through any other competent jurisdictional Police Station, in accordance with law and the procedure, within a time frame as may be fixed by this Court.

ORDER

This writ petition has been filed for direction to respondents 1 and 2 to execute the warrant of arrest dated 16.04.2025 passed in E.A.No.28 of 2024 in C.C.No.171 of 2017 on the file of the State Consumer Disputes Redressal Commission, Chennai, issued to the second respondent through the first respondent and to comply with the conditions therein, by directing the first respondent to issue the warrant through any other competent jurisdictional Police Station, in accordance with law and the procedure, within a time frame as may be fixed by this Court.

The petitioner entered into agreement with the third respondent dated 24.06.2013 to purchase a flat No.306 in D Block, Saveethanjali together with a car park. However, the third respondent failed to execute any sale deed and as such, the petitioner was constrained to file complaint before the Tamilnadu State Consumer Disputes Redressel Commission, Chennai in CC.No.171 of 2017. Thereafter, complaint was lodged before the said Commission and the third respondent was directed to pay a sum of Rs.12,74,325/- together with interest at the rate of 9% per annum from the date of the complaint till the date of realization and also awarded a sum of Rs.25,000/- as litigation expenses. However, it was not complied with and as such, the petitioner filed execution petition in EA.No.28 of 2004. In the execution petition, notice was issued to respondents 4 to 6. Even then, they did not appear. Therefore, the Commission issued warrant to secure them. However, so far the second respondent did not take any step to secure respondents 4 to 6.

In view of the above, the second respondent is directed to execute the warrant of arrest dated 16.04.2025 issued by the Tamilnadu State Consumer Disputes Redressel Commission, Chennai in E.A.No.28 of 2024 in C.C.No.171 of 2017 on the file of the State Consumer

Disputes Redressal Commission, Chennai within a period of four weeks from the date of receipt of this order. The petitioner is also directed to cooperate with the second respondent while executing the warrant issued against respondents 4 to 6 to secure them.

With the above direction, this writ petition is disposed of. There shall be no order as to costs.
