Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondent to consider the petitioner's representation dated 28.10.2016 within a time frame stipulated by this Court. ORDER
According to the petitioner, at the request of the Tahsildar and the Panchayat Board Commissioner, he settled his land in S.No.50/D2 at Melmuthanur Village, Thandarambattu Taluk, Thiruvannamalai District, in favour of the Commissioner of Panchayat Board, in exchange of a land in S.No.50/D3 where he constructed a house, for the purpose of construction of a school for the village. Instead of allotting the land in S.No.50/D3, the Government officials conveyed the land in S.No.50/D1 in favour of the petitioner's wife, which is an agricultural land and not suitable for habitation. Stating so, the petitioner requested the respondents to cancel the settlement deed and return the land executed in favour of his wife, which was not considered. the respondents, requesting to stop the construction till the allotment of the alternate land and further to assign the land in S.No.50/3D3 in favour of him. Finding no response on the same, the petitioner has come forward with this writ petition seeking appropriate direction to the respondents in this regard. 2.Heard both sides and perused the materials placed before this court.
3.Considering the facts and circumstances of the case and having regard to the submissions made by the learned counsel on either side, this court directs the respondents to consider the petitioner's representation dated 28.10.2016, if not considered earlier, and pass appropriate orders, on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.
4.With the aforesaid direction, this writ petition stands disposed of. No costs.
