RNA applicant seeks interim relief to restrain the respondent from issuing a fresh contract to third parties until the sum of Rs.3.29 crores is paid to the applicant.

2. This application is completely misconceived. If the applicant wants to recover its dues, arbitral proceedings should be initiated seeking recovery. By way of interim relief, it is open to the applicant to seek to secure its claim in an appropriate manner. Instead, the applicant seeks to restrain the respondent from issuing a fresh contract. Unless the respondent decides to renew the contract with the applicant or execute a fresh contract in the applicant's favour, it is needless to say that it is open to the respondent to issue a fresh contract to a third party after the expiry of the contract with the applicant.

3. Subject to the above observations, this application is disposed of without any order as to costs.
