PRAYER: Writ Petition has been filed under Article 226 of Constitution of India praying to issue a writ of mandamus directing the respondents to regularise the petitioner in the post of Health Inspector Grade- I with retrospective effect from 01.07.1981 with all monetary and attendant benefits by extending the benefits of order dated 13.07.2007 passed in WP No. 29794 of 2005 passed by this Court and G.O.Ms. No.543 dated 28.11.2025 passed by the 1st respondent within a stipulated period of time. WP No. 18902 of 2026 PRAYER: Writ Petition has been filed under Article 226 of Constitution of India praying to issue a writ of mandamus directing the respondents to regularise the petitioner in the post of Health Inspector Grade- I with retrospective effect from 01.07.

Mr.K.Sathish, Government Advocate COMMON ORDER The above writ petitions are filed for the below relief: "directing the respondents to regularise the petitioner service in the post of Health Inspector Grade- I with retrospective effect from 01.07.1981, 01.07.1981, 01.10.1982 and 01.11.1990 respectively, with all monetary and attendant benefits by extending the benefits of order dated 13.07.2007 passed in WP No. 29794 of 2005 passed by this Court and G.O.Ms. No.543 dated 28.11.2025 passed by the 1st respondent within a stipulated period of time".

2. Heard the learned Counsel on either side and perused the materials available on records.

3. From the records, it is clearly seen that even as early as on 25.08.2015

in a batch of writ petitions in W.P.Nos.26387 to 26403 of 2015 (the petitioners' writ petitions being W.P.Nos.26389, 26392, 26391 and 26402 of 2015), this Court has passed the following order:

"23.Though the petitioner prayed for a larger relief, this Court in the light of the facts and circumstances and without going into the merits of the representations, directs the first respondent to consider and dispose of the petitioners' representations dated 08.06.2015, on merits and in accordance with law after taking note of the above cited orders as well as the Government Orders and administrative instruction and pass orders within a period of twelve weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioners."

4. However, it appears that the State had taken up the matter on appeal right up to the Hon'ble Supreme Court unsuccessfully and had also unsuccessfully contested the review petition. Thereafter, with reference to the one set of petitioners, the respondents had complied with the orders of this Court by passing a government order in G.O.(Ms)No.278 dated 13.06.2019, Health and Family Welfare (L1) Department, followed by a government order in G.O.(Ms)No.543 dated 28.11.2025, Health and Family Welfare (L1) Department.

However, despite being aware of the orders of this Court dated 25.08.2015 in W.P.Nos.26387 to 26403 of 2015, the first respondent has not chosen to include these petitioners in the aforesaid government orders. Therefore, the first respondent is in clear contempt of the orders of this Court dated 25.08.2015 in W.P.Nos.26387 to 26403 of 2015. Therefore, the first respondent is granted time till 29.06.2026 to comply with the orders of this Court 25.08.2015 in W.P.Nos.26387 to 26403 of 2015 following the government orders that is followed in this regard.
