When the matter was taken up for consideration, the learned counsel for the petitioner, on instructions submitted that subsequent to filing of the writ petition, a suit came to be filed, which is pending. Hence, the prayer sought for in the writ petition has become infructuous and hence, nothing survives for adjudication in this writ petition.

Recording the said submission, the writ petition is disposed of with liberty given to the petitioner to raise all the contentions made in the writ petition before the Civil Court, where the suit is stated to be pending.
