ORDER : The Court Made the following order :- The petitioners seek anticipatory bail pursuant to the Non Bailable Warrant issued against him in C.C.No.56 of 2013, pending on the file of the learned Judicial Magistrate No.II, Hosur, for the offences under Sections 147, 148, 294(b), 452, 365, 342 & 506 (ii) of IPC.

2. The learned counsel for the petitioners would submit that the petitioner did not know about the case and now only, one of the accused informed about this case to the petitioner. He would further submit that he is ready and willing to abide by any condition to be imposed by this Court.

3. The learned Additional Public prosecutor would submit that the charge sheet has been filed and the same has been taken on the file of the Judicial Magistrate No.II, Hosur, and subsequently NBW has been issued against the petitioner.

4. Considering the fact that the learned trial Judge has issued non-bailable warrant against the petitioners and the relief available to the petitioner to recall the NBW by filing petition under appropriate provisions of law, the petitioner is directed to appear before the learned Judicial Magistrate No.II, Hosur, on 28.05.2018 and file a petition to recall the non bailable warrant on the same day. On filing of such petition, the learned Judicial Magistrate No.II, Hosur, is directed to consider the said petition

on the same day and pass orders on merits.

5. With the above directions, the petition is disposed of. -sd/- 03/05/2018 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.) High Court, Madras - 600 104.
