(in both W.P's) For Petitioners : Mr.J.Lakshminarayanan For Respondents : Ms.S.Pavithra Standing Counsel for Transport Corporation COMMON ORDER The instant writ petitions have been filed with a prayer for issuing a Mandamus, to direct the respondents to pay 8% interest for the belated payment of provident fund amount, earned leave salary, gratuity and pension commutation amount within a time limit to be stipulated by this Court. 2.
The case of the petitioners is that they were appointed in the respondent Transport Corporation on 28.08.1986 and 21.08.1998 respectively and after completion of unblemished service, the petitioners were retired on 29.02.2020 and 31.05.2023 respectively. However, the petitioner viz., L.Nedunchezhian was settled with the 1st instalment of provident fund on 20.05.2020 and the 2nd instalment on 20.06.2020 and
earned leave salary and gratuity on 03.06.2021 and the petitioner viz., R.Renu was settled with terminal benefits on 10.03.2025 and 11.03.2025 and no interest has been paid for the delayed period. In view of the same, the petitioners submitted representations to the respondents to pay interest for the delayed period. Since the same were not considered, the present Writ Petitions have been filed.

The learned Standing Counsel for the respondents would fairly submits that in view of the similar order passed by this Court in W.P.Nos.40031, 33742 and 35806 of 2024, they are willing to pay the interest at the rate of 6% per annum for the belated payment of the eligible and admissible amount.

Heard the learned counsel for both sides and perused the materials available on record.

In view of the above submission of the learned Standing Counsel, this Court deems it appropriate to direct the respondents to pay interest at the rate of 6% per annum for the belated payment of admissible
terminal benefits from the date of retirement till the date of actual disbursal of the terminal benefits of the petitioners within a period of six weeks from the date of receipt of a copy of this order.
In the result, the Writ Petitions are disposed of with the above observations. No costs.
