Respondents This Writ Petition filed under Article 226 of the Constitution of India praying this Court to issue a writ of mandamus directing the Respondent to send the No Objection Certificate or the necessary papers enabling the Passport Authority to renew the Passport No.Z1761112 stood in the name of the Petitioner within a date fixed by this Honourable Court. O R D E R

Petitioner has filed this writ petition praying for a direction to the respondent to give No Objection Certificate and necessary papers to enable the petitioner to renew his passport.

2. The learned Government Advocate on instructions from the Deputy Commissioner of Police, Central Crime Branch-II, Chennai submitted that a case has been registered against the petitioner in CCB Cr.No.08/2012 u/s. 420, 423, 447, 465, 468, 471 and 506 (i) IPC and in the note appended to the written instructions, it has been stated that investigation has been completed and final report has been approved by the Assistant Public Prosecutor and it has to be laid before the concerned Court. The officials from the Central Crime Branch, namely, S.R.G.Thayal, Inspector of Police and C.Subramanyam Raju, Inspector of Police are present before this Court today and the learned Government Advocate is directed to ascertain as to when the charge sheet will be laid before the concerned court.

3. The learned Government Advocate has ascertained from the officials present that the charge sheet will be laid before the concerned court within a period of two weeks from today.

4. Accordingly, the writ petition is disposed of by directing the Deputy Commissioner of Police, CCB-II, Chennai to lay a final report before the concerned court on or before 26.11.2015. As soon as the matter is entertained by the court concerned and number is assigned, it is open to the petitioner to file an application before the concerned court to seek for appropriate orders with regard to his grievance that his passport has to be renewed. In the event of filing of such application, the concerned court shall consider the same and pass appropriate orders on merits and in accordance with law.
