PRAYER Writ petition filed under Article 226 of Constitution of India for the issue of writ of Mandamus directing the 1 st and 2 nd respondents to survey and fix the boundary stones of the petitioner's property for the land in Cuddalore R.D., Nellikuppam Sub D., Anna grahma panchayat union, Perumalnayakkanpalayam village, Wet New Survey No.143/6 (old survey no.84) in this extent of 1.27 cents and to direct the 3rd and 4th respondents to give necessary police protection to enable the 2nd respondent to measure the land based on her application for the survey and fixing the boundaries vide Challan No.2024/ 0123/ 18/ 007592 dated 29.10.2024.

ORDER

This writ petition has been filed for the issue of writ of Mandamus directing the 1 st respondent to act upon the on-line application submitted by the petitioner on 29.10.2024 wherein the petitioner is seeking for survey of the subject property and for demarcation of boundaries.

Heard Mr.P.Sarveswaran, learned counsel for the petitioner and Mr.A.Selvendran, learned Special Government Pleader for Respondents 1 and 2 and Mr.Meganathan, Government Advocate for respondents 3 and 4. 3.

The petitioner is relying upon the Settlement deed dated 28.01.2010 registered as document No.483 of 2010. The petitioner is also relying upon the patta that stands in the name of the petitioner in Patta No.1488. The petitioner wanted a survey to be conducted and hence, submitted an on-line application on 29.10.2024. Since the same was not acted upon, the present writ petition has been filed before this Court.

Taking into consideration the facts and circumstances of the case and considering the materials placed before this Court, there shall be a direction to the 1 st respondent to act upon the on-line application submitted by the petitioner and conduct the survey in the subject property based on the title document and the patta that stands in the name of the petitioner. This process shall be completed within a period of four weeks from the date of receipt of the copy of this order. If any police protection is required, the same shall be provided by the 4 th respondent. If there are any rival claimants, the survey shall be conducted in their presence.

This writ petition is disposed of with the above directions. No costs.
