These applications are filed to condone the delay of 602 days in filing the petition to set aside the abatement caused due to the death of the 1st defendant; to set aside abatement caused due to the death of the 1st defendant; and to bring on record the respondents 2 to 4 being the legal heirs of the deceased 1st defendant as defendants 3 to 5 in C.S.No.68 of 2020.
2. The learned counsel for the applicant would submit that despite the legal heirs of the deceased 1st defendant stood as parties (plaintiffs 2 to 4) in the connected T.O.S.No.31 of 2017, the death of the 1st defendant was not brought to his notice. 3. Sufficient reasons have been given in the affidavit filed in support of these applications. Therefore, these applications are allowed.
4. Mr. A.Vimal Raj, for M/s.N.R.Anantha Rama Krishanan has filed a change of vakalat for the plaintiffs in C.S.No.68 of 2020.
5. List the matter on 03.07.2023, after carrying out amendment.
