ORDER
(The case has been heard through video conference) The Criminal Original Petition has been filed under Section 482 Cr.P.C. to call for the records relating to the impugned First Information Report in Crime No.4 of 2014 on the file of the first respondent police viz. the Inspector of Police District Crime Branch, Kancheepuram District and quash the same in so far it relates to the petitioners.
2.When the matter was listed before this Court on 27.01.2021, there was no representation for the petitioners and thereby, this Court had directed the matter to be listed today under the caption "for dismissal".
3.On the earlier occasion, it was represented by the learned Additional Public Prosecutor that the connected Crl.O.P.No.21457 https://hcservices.ecourts.gov.in/hcservices/
of 2014, filed by the 1st accused vz. Mr.Durai was disposed on 11.02.2020 with a direction to complete the investigation in Crime No.4 of 2014.
3.The learned Additional Public Prosecutor would submit that pursuant to the directions of this Court, the respondent police have proceeded with the investigation and that they will be able to file a final report at the earliest. He would further submit that there are specific materials against the petitioner and the alleged offences are under Section 294(b), 420, 506(i) IPC, the victim has been cheated to the tune of Rs.60 Lakhs and that the case is of the year 2014.
4.Despite the matter being listed today under the caption "for dismissal", neither the petitioners nor their counsel is present before this Court to prosecute the case. It is a case of the year 2014 and it is submitted by the learned Additional Public Prosecutor that pursuant to the order passed by this Court in Crl.O.P.No.21457 of 2014, filed by A1 viz. M.Durai, the respondents have proceeded with the investigation and they will be ready with the final report. Hence, no purpose will be served by keeping the matter pending.
5.In view of the same, this Court is inclined to dismiss this Petition for non prosecution, with a direction to the 1st respondent / The Inspector of Police, District Crime Branch, Kancheepuram District, to complete the investigation at the earliest, preferably within a period of four months from today and file the final report.
4.With the above direction, this Criminal Original Petition stands dismissed for non prosecution. Consequently, the connected miscellaneous petition is closed.
