ORDER

The petitioners, who were arrested and remanded to judicial custody on 15.03.2026, for the offences punishable under Section 103(1) of BNS in Crime No.117 of 2026, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that due to previous enmity, the petitioners, along with other accused, jointly attacked the deceased with a sickle and a screw driver and due to the injuries sustained, the deceased died. Hence the case has been registered and the petitioners were arrested.

3. The learned counsel for the petitioners submitted that the petitioners have been falsely implicated in this case and that they have been in judicial custody since 15.03.2026. The petitioners are ready to abide by any condition that may be imposed by this Court. Hence, he prayed that bail may be granted to the petitioners.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that there are witnesses connecting the accused with the occurrence and he further submitted that both the accused were arrested and the investigation is not concluded. He

further submitted that there are no bad antecedents against the petitioners. Hence, he opposed for grant of bail to the petitioners.

5. I have considered the submissions made on both sides and perused the records. The facts revealed that it is not only a case of murder but it is also screening of offence. Hence, I am not inclined to grant bail to the petitioners at this stage.
