..Respondent(s) Prayer: This writ petition is filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the 3rd respondent to return the gold jewels weighing about 1031-4 grams of the petitioner pledged vide four gold loan A/c Nos.08440610037935, 08440610041093, 08440610040898 and 08440610040744 with the 3rd respondent.

ORDER

When the matter was listed for hearing on earlier occasion i.e., on 06.03.2026, none appeared on behalf of the petitioner, hence, this Court directed the Registry to list the case today i.e., on 10.06.2026 under the caption " For dismissal".

2. Today, when the matter was taken up for hearing, there was no representation for the petitioner. However, learned counsel appearing for the third respondent would submit that the petitioner has filed this writ petition to direct the third respondent to return the gold jewels weighing about 1031-4 grams, pledged with the third respondent by his father, who has died. The loan amount for the pledged gold has already been paid, but the succession certificate was not produced before the third respondent. Once the succession certificate is produced, they are ready to return the gold.

3. Though brief submission was made by the learned counsel for the third respondent, there was no representation for the petitioner. Hence, this Court has no other option except to dismiss this writ petition.

4. Accordingly, this writ petition is dismissed for non-prosecution. No costs.
