O R D E R

The petitioner herein is son of the 5th respondent is before this Court seeking direction to the 2nd respondent to give protection. The other private respondents are his sister and brother in law.

2. The Learned Counsel for the petitioner had stated that earlier the petitioner was brutally attacked by the private respondents and the police has not acted upon his complaint. Only after intervention of Court direction, the case was altered to Section 294-B, 324, 506 (ii) and 307 of I.P.C and the investigating is still pending. The petitioner herein is not permitted to enter the house by the private respondents, hence seeks for police protection.

3. From the submission made by the Learned Counsel, this Court find that, there is dispute between the family members and therefore, complaint has Page No.2/4

been filed by the petitioner herein against his own sister, brother-in-law and father and same is pending.

4. In the said circumstances, protection to the petitioner herein to enter the house where he has already been brutally attacked might not be proper. Hence, the Police cannot provide 24 x 7 protection to any person, moreso, when the person is inclined to enter into the zone of danger, where his life already been attempted. Accordingly, this Criminal Original Petition is dismissed. 10.11.2023 Index :Yes/No.
