O R D E R

The relief sought for in the present writ petition is to direct the respondent to settle the appropriate share of the amount accrued in the savings account bearing Account No.10029792432 of deceased Mr.Aravindhan to the petitioner and her minor son and daughter.

2. Admittedly, the Savings Bank Account Holder is Mr.Aravindhan, who is the husband of the writ petitioner Tmt.Nagalakshmi. The Account Holder Mr.Aravindhan died in the year 2020. Near about a sum of Rs.1,06,339/- is available in the Savings Bank Account of the deceased husband of the writ petitioner. The petitioner submitted an application before the first respondent-State Bank of India to pay her share in the said Savings Bank Account of her deceased husband. Since no action

was taken by the first respondent-Bank, the writ petitioner is constrained to move the present writ petition.

The learned counsel appearing on behalf of the first respondent-State Bank of India made a submission that the first respondentState Bank of India is ready and willing to settle the respective shares of the legal heirs of Mr.Aravindhan on production of requisite documents to the satisfaction of the first respondent-Bank. In this connection, set of forms were supplied to the writ petitioner enabling her to submit the same for considering her claim by the first respondent-Bank.

The learned counsel for the first respondent-State Bank of India further states that the first respondent-Bank is ready to assist the petitioner by providing one more set of papers enabling her to submit the same for the purpose of receiving her share from the Savings Bank Account of her deceased husband as per the Regulations. It is made clear that the second respondent is also at liberty to submit such applications for the purpose of claiming her share.

This being the submissions of the learned counsel appearing on behalf of the first respondent-State Bank of India, the petitioner is at liberty to approach the Bank Authorities and produce the requisite documents in compliance with the procedures and on production of such requisite documents, the first respondent-State Bank of India is directed to consider the claim of the petitioner on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.
