Criminal Original Petition filed under Section 438 of Cr.P.C., to enlarge the petitioners on bail in the event of their arrest in Connection with the Crime No.1512 of 2020 pending on the file of the respondent police.

ORDER

(This case has been heard through video conference) The petitioners who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 341, 294 (b), 307 of IPC r/w. Section 3 of TNPPDL Act, in Crime No.1512 of 2020, on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution as per the defacto complainant is that due to enmity, there was a wordy quarrel between the petitioners and the defacto complainant. The petitioners assaulted the defacto complainant with knife and damaged the two wheeler. Hence, the complaint.

3. The learned counsel for the petitioners would submit that the petitioners are innocent persons and they have been falsely implicated in this case. He would further submit that they have not committed any offence as alleged by the prosecution. Therefore, he prays for grant of anticipatory bail to the petitioners.

The learned Additional Public Prosecutor would submit that the first petitioner has been remanded to judicial custody and the second petitioner has three previous cases, one is under TNP Act and another one is 394 of IPC and yet another case is Hurt Case. Hence, he opposed for grant of anticipatory bail to the petitioners.

5. Taking into consideration the facts and submissions of the learned Counsel and also the fact that the first petitioner has been remanded to judicial custody and the second petitioner has three previous cases, this Court is not inclined to grant anticipatory bail to the petitioners.

Accordingly, this Criminal Original Petition is dismissed.
