The petitioner, who was arrested and remanded to judicial custody on 28.04.2024 in connection with Crime No.69 of 2024 registered for the alleged offences punishable under Sections 457, 381, 201 r/w 120 B of IPC, seeks bail.

2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner was arrested in this case only due to the suspicion. He also submitted that the petitioner has been suffering incarceration from 28.04.2024 and he is ready to abide by any stringent conditions that may be imposed by this Court, hence, he prayed for grant of bail to the petitioner.

3. Learned Government Advocate (Criminal Side) appearing for the respondent police submitted that the petitioner/A2, who was working in the Electronic Accessories Shop run by the de facto complainant, along with other accused trespassed into the de facto complainant's shop and committed theft of Rs.9,50,000/- and also taken the DVR from the CCTV. He further submitted that the petitioner is the native of Rajasthan and the respondent has arrested him from his native with great difficulty, however, the first accused in this case is still absconding. He also submitted that the investigation in this case is also pending and there was no recovery from the accused. Hence, he prayed for dismissal of the petition.

Taking into consideration the facts and circumstances of this case and the submissions made by the learned Government Advocate (Criminal Side) that the investigation in this case is at the initial stage and also considering the fact that the first accused is still absconding, this Court is not inclined to grant bail to the petitioner.
