(a) to take the report on record;

(b) to direct the Official Liquidator to meet out the clearing charges of Rs.9,62,880/- from and out of the Common Pool Fund Account and recoup the same after realisation through sale of the property; (c) to direct the Official Liquidator to pay a sum of Rs.9,62,880/- towards clearing charges to M/s.Bheema Groups, JCB Operator, Gummidipoondi as per quotation given by them from and out of CPF A/c. ORDER

mmi Gummidipoondi from and out of the common pool fund account subject to the condition that said amount would be recouped from the sale proceeds of the property of the company in liquidation.

2. In the report filed in support of this application, the Official Liquidator has stated that the services of the above mentioned JCB operator was availed of to remove the bushes from the lands of the company in liquidation at Peruvoyal Village, Gummidipoondi Taluk of the extent of 18.82 acres. It is also stated that the work was entrusted after obtaining permission from this Court.

3. Upon considering the averments in the report, this application is liable to be and is hereby allowed in terms of reliefs requested in clauses (b) and (c).
