Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in Criminal Appeal No.250/2017 on the file of the High Court, the High Court will be pleased to suspend the sentence imposed on the petitioner by the Judgment dated 25.11.2016 made in S.C.No.13 of 2014 on the file of the Sessions Judge, Mahila Court, Chennai enlarge him on bail pending appeal. Order : This petition coming on for orders upon perusing the petition and the Memorandum of Grounds in Crl. Appeal No.250/2017 on the file of the High Court and upon hearing the arguments of M/S.N.KUMANAN, Advocate for the petitioner and of MR.P.LOVINDA RAJAN ADDL.
PUBLIC PROSECUTOR, on behalf of the Respondent the court made the following order:- This Miscellaneous Petition is taken up by the appellant in the appeal who has been convicted by the Mahila Court, Chennai in S.C. No.13 of 2014 by judgment dated 25.11.2016, for an offence under Section 302, IPC. He was sentenced to undergo imprisonment for life. Since the conviction and sentence have been imposed on the appellant only after the offence having been established by a full fledged trial, we do not find this to be an appropriate case where sentence should be suspended. Hence, we see no justifiable reason to entertain the request of the petitioner for suspension of sentence.
