This application has been filed by the applicant / plaintiff to direct the respondent / first defendant to pay a sum of Rs.1,00,000/- per month towards the educational and hostel expenses and maintenance of the plaintiff pending disposal of the suit.

2. The suit itself has been filed for claiming partition and not for maintenance. In such circumstances, this application has been filed seeking for interim maintenance which is fundamentally not maintainable. Also, at the time of filing the application the applicant / plaintiff is alleged to have been pursuing his second year in Engineering Course. By now, he would have completed his engineering course or might be pursuing his final year in the said course.

3. Hence this application is not maintainable and the same is dismissed.
