The respondent/accused viz., Vasanthakumar present today and he was questioning about the sentence. He has given written submission expressing his difficulty due to his ill-health and taking note of the family situations seeks lessor sentence.

The accused is found guilty of the offence under Section 13(2) r/w 13(1)(e) of the Prevention of Corruption Act, 1988. The alleged offence has taken place during the check period commencing from 01.01.1991 to 31.12.2000. At the relevant point of time, the punishment prescribed for the offence under Section 13(2) of the PC Act, is minimum sentence of one year and maximum sentence of seven years.

In the light of the said legal position and considering the plea of the accused, he is sentenced to undergo one year simple imprisonment and fine of Rs.1,00,000/- (Rupees one lakh only) in default to undergo simple imprisonment for a period of two months. Time to surrender is granted till 15th May, 2023.
