It is seen from the documents filed in the form of typedset of papers that the petitioner has filed a suit in O.S.No.115 of 2014 for injunction in respect of the property, comprised in S.No.248/1B3, having 28 cents. It is the case of the petitioner that in respect of the said property, a Will was fabricated in favour of one Aparanji, who sold the property in favour of Kishta Goundar. Based on the said concocted Will, the petitioner's, peaceful possession has been disturbed. It also appears that regarding the said criminal act, the petitioner has given complaint before the District Registrar, and now, by way of this Petition, the petitioner wants action to be taken against those persons, who were involved in fabrication of forged documents.

According to me, Whether the Will was a fabricated document or whether the property in S.No.248/1B3, having 28 cents, was interpolated in the Will, has to be decided in the suit filed before the Trial Court and the petitioner can seek his remedy only before the Trial Court, where, O.S.No.115 of 2014 is pending. https://hcservices.ecourts.gov.in/hcservices/

In the result, the Criminal Original Petition is dismissed.
