The petitioners who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 294(b), 323 and 506(ii) of IPC, in Crime No.64 of 2022, seek anticipatory bail.
2. The case of the prosecution is that A1 and A2 are the parents of one Ilamparuthi and the said Ilamparuthi had betrothal with the defacto complainant. Thereafter, the said Ilamparuthi, refused to marry the defacto complainant, due to which a wordy quarrel arose between the petitioners and the defacto complainant. Hence, the complaint.
3. The learned counsel for the petitioners submitted that the petitioners are innocent persons and no way connected with the alleged offence. Hence, he prays to grant anticipatory bail to the petitioners.
4. The learned Additional Public Prosecutor submits that A1 and A2 are the parents of one Ilamparuthi. The said Ilamparuthi got engaged with the defacto complainant and later refused to marry her. 5. A perusal of the First Information Report reveals that the son of A1 and A2, fell in love with the victim girl and on pretext of marriage they had physical relationship on several occasions. In fact, they were allowed to marry and after engagement, A1 and A2 refused for their son's marriage. Now, they also failed to disclose the whereabouts of their son. When it was questioned by the defacto complainant, she was beaten by the petitioners herein and refused to marry her with the son of A1 and A2.
6. Taking into consideration the facts and circumstances of the case and the bad antecedents of the petitioners, the custodial interrogation of the petitioners is very much required in this case. Hence, this Court is not inclined to grant anticipatory bail to the petitioners.
