Criminal Original Petition filed under Section 482 Cr.P.C. praying to call for the entire records pending in C.C.No.90 of 2013 from the file of learned Judicial Magistrate No.II, Cheyyar, Thiruvannamalai District, hear the counsel for the Petitioners and quash the Charge Sheet (Final Report) filed by the Respondent in Crime No.460 of 2012 of Peranamallur Police Station, Vandavasi Taluk, Thiruvannamalai District. ORDER

This petition has been filed to call for the entire records pending in C.C.No.90 of 2013 from the file of learned Judicial Magistrate No.II, Cheyyar, Thiruvannamalai District, here the counsel for the Petitioners and quash the Charge Sheet (Final Report) filed by the Respondent in Crime No.460 of 2012 of Peranamallur Police Station, Vandavasi Taluk, Thiruvannamalai District, having been taken cognizance for the offences punishable under Sections 147, 148, 341, 323, 324 and 506(i) IPC r/w 34 of IPC.

2. It is seen that when the matter was posted on 02.06.2014 "For Admission", the learned counsel appearing for the petitioner took an adjournment and the matter was adjourned after two weeks. Thereafter, for the past four years, the learned counsel has not taken any steps to list the matter. It shows that the petitioner has no interest to pursue the matter. Further it is pending for more than five years without even ordering notice. Now after the lapse of four years period, this petition cannot be considered and this Court is not inclined to entertain this petition.

3. In view of the above, this Criminal Original Petition is dismissed. Consequently, connected miscellaneous petition is closed.
