This petition is filed under Section 378 (4) Cr.P.C, to grant leave to file an appeal against the order dated 17.04.2023 made in STC.No.667 of 2021 on the file of the learned Judicial Magistrate No.1, Gobichettipalayam.
2.Heard Mr.N.Manoharan, learned counsel for the petitioner. 3.Learned counsel for the petitioner contended that though the accused had admitted his signature in the promissory note, the trial court had acquitted the accused. He further contended that the trial court judge failed to take note on certain relevant factors and that there are arguable points in the main appeal and therefore, leave is granted as prayed for. 4.Registry is directed to number the Criminal Appeal, if it is otherwise in order and list the matter under the caption "For Admission" in the usual course.
