1. M/s.Sri Vishnu Magnetic Pvt. Ltd. and another ... Respondent - - - - Both the counsels on instructions have made an endorsement in the Court bundle agreeing for appointment of a new Arbitrator in place of the old Arbitrator. The applicant in Application No.2739 of 2023 on instructions has also given instructions to his counsel to make an endorsement in the Court bundle that the allegations levelled against the respondent in the said application stands withdrawn.

2. Both the learned counsels on instructions have also made an endorsement that they are agreeable for the appointment of Mr.D.Saravanan, learned counsel as a sole Arbitrator to decide the dispute between the parties arising out of a Manpower Agency agreement, dated 01.03.2012.

3. Accordingly, this Court appoints Mr.D. Saravanan, learned counsel as Arbitrator, who is having office at "Raheja Towers", Unit No.208, Beta Wing, 2nd Floor, No.113-134, Anna Salai, Chennai - 600 002 (Mobile

No.9840044177) as a sole Arbitrator to decide the dispute between the petitioner and the respondent arising out of the Manpower Agency agreement, dated 01.03.2012.

4. Both the parties have also agreed to pay the Arbitrator fees in accordance with the 4th schedule to the Arbitration and Conciliation Act, 1996 and they also agreed that the fees shall be shared equally.

5) The Arbitrator shall pass the Arbitral Award, within the stipulated time as prescribed under the Arbitration and Conciliation Act, 1996 by adhering to all the provisions of the said Act.

6) As per the aforesaid terms, this application is disposed of. Consequently, remaining applications are closed. 10.07.2023 vsi2
