Advocate (Criminal Side) for RR-1 to 6 COMMON ORDER Both the present Writ Petitions have been filed to direct the first and second respondents to take necessary action against the seventh and eighth respondents on the petitioner's representation letter dated 19.04.2025.
2. The main grievance of the petitioners is that, despite giving complaint, with proper materials, the respondents 1 and 2 have not taken any action against respondents 7 and 8, since they are Councillor or wife of the Councillor of the ruling party. Under the influence of respondents 7 and 8, they are also threatening the petitioners and have also put up shed. In order to substantiate the same, the petitioners' counsel had also produced pen-drive consisting of photographs and CCTV footage and in which the respondents have been present in the scene of occurrence. In view of the same, this Court finds 3 / 6
that there are prima-facie materials against the respondents.
3. Hence, the second respondent is directed to take action against the respondents 7 and 8 and consider the representation/letter of the petitioners, dated 19.04.2025 and conduct enquiry and if prima-facie case is made out, register a case against them and proceed further in accordance with law.
4. However, the properties in occupation of the petitioners are also alleged to have been the Government properties and therefore, the first respondent is directed to take appropriate steps in case the occupation of the petitioners is a Government Poramboke and take action against the petitioners also in accordance with law and evict the petitioners, if necessary, by due process of law.
5. With the above observations/directions, these Writ Petitions are disposed of. There shall be no order as to costs. 13.06.2025 cs 4 / 6
