..Respondent(s) PRAYER: This criminal original petition filed under Section 528 of BNSS Act, to direct the 1st respondent herein to transfer the investigation of the case in Crime No.65 of 2026 on the file of the 2nd respondent herein and transfer the same to any other Inspector of Police under him who is honest and efficient in conducting the investigation and to investigate the matter in accordance with law and render justice.

ORDER
This criminal original petition has been filed to direct the 1st respondent herein to transfer the investigation of the case in Crime No.65 of 2026 on the file of the 2nd respondent herein and transfer the same to any other Inspector of Police.
2.The petitioner lodged a complaint and the same was registered in crime No. 65 of 2026 on 20.02.2026. Thereafter, no proper investigation has been conducted.
3.The contention of the petitioner is that the accused, in this case, was employed in the petitioner's provision shop and she misappropriated huge sums of money and the money transferred to her husband's account. The second respondent police has not taken any action and the amount has not been recovered, hence, filed this petition.
4.The learned Additional Public Prosecutor appearing for the respondents submitted that there is a case and counter case. The accused in crime No.65 of 2026 for offences under Sections 316 (4) of BNS, 2023, lodged a complaint against the petitioner and a case in crime No.64 of 2026 for offences under Sections 126(2), 296(b), 115 (2), 74, 351(3) of BNS, 2023 and Section 4 of
Tamil Nadu Prohibition of Harassment of Woman (Amendment) Act, 2002 has been registered. The complainant in crime No.64 of 2026 was kept in confinement on the allegation of misappropriation of funds and she was also molested, harassed and other offences have been committed. Now, in both the cases, investigation is in progress. In any event, both cases investigation to be conducted simultaneously.
5.In the facts and circumstances of the case, this Court is not inclined to interfere with the investigation conducted by the second respondent Police at this stage.
6. In the result, this Criminal Original Petition is disposed of and the respondent Police is directed to follow Police Standing Order 566 and proceed further with the investigation in accordance with law and complete the investigation and file a final report or a closure report, as the case may be. 28-04-2026 Index: Yes/No Speaking/Non-speaking order sms
