ORDER

This criminal original petition has been filed to transfer the investigation of the case in crime No.19 of 2026 on the file of the 2nd respondent herein and transfer the same to the file of any officer. 2.The petitioner lodged a complaint and the same was registered in crime No.19 of 2026 on 13.03.2026. Thereafter, no proper investigation has been conducted.

3.The contention of the petitioner is that on referring to the medical report, it is submitted that the injuries are serious in nature but only offence under Section 324 registered and not under Section 307. Hence, this petition. 4.The learned Additional Public Prosecutor appearing for the respondents submitted that there is a case and counter case. The counter case is in crime No.20 of 2026 for offences under Sections 294(b), 115(2), 118(1), 351(3) of BNS, 2023 and Section 4 of Tamil Nadu Prohibition of Woman Harrassment Act. He further submitted that it is for the investigating officer to consider the medical report and based on the statement of the doctor, if the injuries are found to be serious in nature, appropriate steps would be taken.

5.In the facts and circumstances of the case, this Court is not inclined to interfere with the investigation conducted by the second respondent Police at this stage.

6. In the result, this Criminal Original Petition is disposed of and the respondent Police is directed to follow Police Standing Order 566 and proceed further with the investigation in accordance with law and complete the investigation and file a final report or a closure report, as the case may be. 28-04-2026 Index: Yes/No Speaking/Non-speaking order sms To
