Criminal Miscellaneous Petition is filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita (BNSS) 2023, to relax the condition which was imposed on the petitioners in Crl.Appeal No.215 of 2025 order dated 18.03.2026 report before the Komaralingam Police Station, daily at 10.30 a.m. until further orders and pass such other further orders as this Hon'ble Court may deem fit and proper in the circumstances of the case and thus render justice For Petitioners :

ORDER
This Criminal Miscellaneous Petition has been seeking relaxation of Condition No.7(b) imposed by this Court by order dated 18.03.2026, insofar as it directs the Petitioner to appear before the 2nd Respondent Police everyday at 10:30 A.M.

Paragraph No.5 of the affidavit filed in support of this petition reads as follows:- "4. The appellants further submits that as far as the second condition is concerned, he has been regularly appearing before the Komaralingam Police Station, Tiruppur District from 20.03.026 daily at 10.00 am without fail. They further submits that they have been regularly appearing before the Komaralingam Police Station, till now.
5. The appellants further submits that they have been daily appearing before the Komaralingam Police Station.
The journey hours between the petitioner's native place and the respondent Police Station is about 2 hours, hence, they could not go to any work, their family members are struggling without any revenue. Hence, the appellants approaching this Hon'ble Court to relax the condition which was imposed on the petitioners in Crl.A.No.215 of 2026 dated 18.03.2026. the appellants further submit that they have been scrupulously complied the condition and appeared before the respondent police as per the direction of this Hon'ble Court. The appellants further submit that the substantial investigation has been completed. " 3.
The earlier order granting bail to the Petitioner, subject to certain conditions, was passed after notice had been served on the 3rd Respondent/de facto complainant. However, there was no representation on behalf of the 3rd Respondent/de facto complainant.

The learned State Public Prosecutor appearing for the Respondents 1 and 2 submitted that the Petitioner has been complying with the order only from 26.03.2026 and not from 20.03.2026.

Having considered the submissions made by the learned counsel on either side, and upon perusal of the reasons stated in Paragraph No.5 of the affidavit filed in support of the present petition, particularly the averment that it takes nearly two hours for the Petitioner to travel from his residence to the 2nd Respondent Police Station, I am inclined to relax the condition No.7(b) by directing the Petitioner to appear before the Komaralingam Police Station once
in a month at 10:30 A.M., on the first working day of each English Calendar month, without fail.

In case, if the Petitioner is failed to comply with any of the conditions imposed by this Court, the benefit of this order will stands withdrawn, and the Petitioner shall be bound to comply with the earlier order dated 18.03.2026 made in Crl.A.No.215 of 2026. 7.
Accordingly, this Criminal Miscellaneous Petition is ordered as prayed for.
