ORDER

The petitioner, who was arrested and remanded to judicial custody on 18.06.2025 for the alleged offences under Sections 8(c), 20(b)(ii)(C) & 29(a) of NDPS Act, 1985, in Crime No.254 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 05.04.2025 at about 11.15 a.m., the petitioner along with A1 was found in illegal possession of 21.200 kilograms of ganja. Hence, the case has been registered.

3. The learned counsel appearing for the petitioner submitted that the petitioner is in no way connected with the alleged offence and has been falsely implicated in the case. It is further submitted that the petitioner was not present at the place of occurrence and that no contraband was recovered from him. It is also submitted that the entire recovery was effected only from A1. Hence, he prayed for grant of bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent submitted that on the date of occurrence the petitioner fled away from the scene and therefore no recovery could be effected from him. It is further submitted that the total quantity involved is 21.200 kilograms of ganja, which is a commercial quantity. The petitioner is also stated to be involved in six previous cases, out of which two have been disposed of.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

From the submission of the learned counsel on either side, this Court is of the view that the quantity involved is a commercial quantity attracting the rigour under Section 37 of the Narcotic Drugs and Psychotropic Substances Act, 1985. Hence, this Court is not inclined to enlarge the petitioner on bail.
