Prayer: Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, to direct the second respondent to pay the subsistence allowance payable to the petitioner till date.

ORDER

The petitioner has filed this writ petition for a Mandamus, to direct the second respondent to pay the subsistence allowance payable to the petitioner till date.

2. The learned counsel for the petitioner submits that the petitioner was placed under suspension on 25.11.2019 while serving as a Revenue Inspector with the respondents. He further submits that after the charge memo was issued, the petitioner has also given explanation and has attended the enquiry ordered in the aforesaid disciplinary proceedings. He submits that despite lapse of 1 1⁄2 years he has not been paid with the subsistence allowances.

3. The learned Government Advocate for the respondents submits that the subsistence allowances will be paid in terms of the applicable rules to the petitioner.

4. Recording the same, this Writ Petition is disposed by directing the second respondent to pay the subsistence allowances within a period of five weeks from the date of receipt of a copy of this order. No costs.
