2.It is represented by the appellant's counsel that the parties had settled the issues out of the Court and accordingly he seeks permission to withdraw the First Appeal and also made an endorsement to that effect.

3. In the light of the above position, the First Appeal is dismissed as withdrawn. No costs. Consequently, connected miscellaneous petition, if any, is closed.
