Prayer : Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to publish the written test examination result for the post of Scientist Stage-8 held on 07.10.2018 and consequently, direct the 1st respondent to issue the appointment order for the post of Scientist Stage-8, if the petitioner passed in the written test conducted by the 1st respondent. O R D E R

This writ petition has been filed to issue a Writ of Mandamus directing the respondents to publish the written examination result for the post of Scientist Stage-8 held on 07.10.2018 and consequently, direct the 1st respondent to issue the appointment order for the post of Scientist Stage-8, if the petitioner passed in the written test conducted by the 1st respondent.

2. The petitioner claims to have been appointed by the respondent on contract basis as Project Associate. According to him, an advertisement was issued on 06.06.2018, calling for applications for recruitment to the post of Scientist-Stage 8 and Stage 9. The petitioner responded to the call for recruitment for the post of Scientist-Stage 8. Thereafter,

written test was conducted and he appeared to have attended the written test and he claims that till date no result has been published.

3. The petitioner has also stated some change in the qualification prescribed in the advertisement, subsequently. But, what ultimately the petitioner seeking is that to declare the result for the post of Scientist-Stage 8, in pursuance of the written examination held on 07.10.2018 and consequently, issue appointment order.

While praying as such, the petitioner is also strangely seeking a stay of proceedings of appointing 6 persons selected through video conference held on 05.10.2020 and 06.10.2020, who according to him, have been selected for appointment to the post of Scientist-Stage 8 for the same written examination held on 07.10.2018.

5. This Court is unable to appreciate as to what exactly the grievance of the petitioner is, on one hand he seeks a direction to declare the result which is his main prayer and on the other hand he seeks for stay of appointment of some 6 persons who have already been selected for appointment.

6. Moreover, the averments as contained in the affidavit appeared to be completely disjointed and lack coherence. From the averments, this Court is unable to make out any legal sense in order to entertain the writ petition. Further, the petitioner is being aggrieved by the appointment of some persons on the same selection, instead of challenging the selection overlooking his claim, he cannot come up with the prayer for the issuance of Writ of Mandamus.

Even otherwise, this Court does not find any merit in the claim of the petitioner, particularly, when the written examination said to have been taken place in October 2018 and what the petitioner has been doing for two years, has not been explained in the affidavit filed in support of this writ petition.

8. On the whole, this Court is not inclined to entertain this writ petition. Therefore, the writ petition stands dismissed. No Costs. Consequently connected miscellaneous petitions are closed.
