This Criminal Original Petition has been filed under Section 482 Cr.P.C, to call for the records and to quash the First Information Report in Crime No.493 of 2018 on the file of the Sub Inspector of Police, Central Crime Branch, EDF II, Team IX-A, Vepery, Chennai.
2. Today, when the matter was taken up for hearing, the learned counsel appearing for the petitioners and the learned counsel appearing for the second respondent submitted that during the pendency of the proceedings, the parties worked out some settlement between themselves and the terms of settlement have been reduced into writing, as shown in the Joint Memo of Compromise, filed by the parties on 05.11.2020 before this Court.
3. Despite the matter was posted for appearance of the parties, the learned counsel submitted that due to some personal reasons, the parties could not make their appearance. Since the matter has already been settled between the petitioners and the second respondent, there is no point in keeping this proceedings pending.
4. In the result, this Criminal Original Petition stands closed. In this connection, the first respondent is directed to record the statements of the second respondent and close the case. The second respondent is directed to co-operate and make his appearance before the Investigation Officer for getting his statement with regard to compromise, within two weeks. On the appearance of the second respondent, the first respondent would record the statement immediately and close accordingly. Consequently, connected miscellaneous petition is closed.
