Respondent(s) PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying to issue a writ of Certiorarified Mandamus, to call for the records pertaining to the order passed in R.dis No. 3466/2024/A4, dated 09.04.2025 on the file of the 5th respondent herein and quash the same and issue consequential direction to the 1st respondent herein to initiate departmental proceedings on the 5th respondent on the petitioners representation dated 16.04.2025 and pass such further or other orders or directions as this Honble court. ORDER
By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.
2. This writ petition has been filed to call for the records pertaining to the order passed in R.dis No. 3466/2024/A4, dated 09.04.2025 on the file of the 5th respondent herein and quash the same and issue consequential direction to the 1st respondent herein to initiate departmental proceedings on the 5th respondent on the petitioners representation dated 16.04.2025.
3. After submitting for a brief while, the learned counsel for petitioner sought for liberty to prefer an appeal before the Revenue Divisional Officer and on considering the same, orders shall be passed in accordance with law.
4. In the circumstances this Court is inclined to grant liberty, to the petitioner to prefer an appeal before the Revenue Divisional Officer within a period of two weeks from the date of receipt of a copy of this order and the same shall be admitted, if it is otherwise in order without reference to limitation. The appellate authority shall thereafter pass orders after issuing notice to the petitioner and any other interested parties in accordance with law.
5. In view of the above direction, this Writ Petition is disposed. No costs. Connected miscellaneous petition is closed.
