On a complaint given by one K.Suresh alleging that the petitioner herein handed over title deeds and patta in respect of property in S.No.14/1, 16, 17/1, 17/2A, 17/2B, 19, 24, 11/11, 13/2, 18, 18/2 and 20/2 totalling to 6.63 hectares of vacant land at Semmancherry stood in the name of Thallaraam, Sowcarpet and claimed himself as the Power of Attorney agent of the said Thallaraam and received a sum of Rs.70 lakhs. Thereafter, it was found that the title deeds and patta handed over by him are fabricated and fake documents. Hence, action for cheating sought. Based on the complaint, case has been registered by the respondent police and is under investigation. 2.
While so the learned counsel for the petitioner has moved the anticipatory bail petition stating that there was no transaction between the defacto complainant and the petitioner as alleged in the complaint and in fact, they both had some transaction pursuant to the agreement entered during the month of September 2017 which captioned as Memorandum Of Understanding in respect of the property at Urappakkam and in connection with that transaction there is already a civil suit pending. While so, to wreck vengeance, false complaint has been given as if Rs.70 lakhs was received by the petitioner herein claiming as Power Agent of Thallaraam and producing fake title deeds. https://www.mhc.tn.gov.in/judis 1/2

However, learned Government Advocate would submit that modus operandi conceived by this petitioner and his associate Thallaraam is to identify valuable properties of landlord in extenso, create Power Of Attorney deed by impersonation and alienate the property to third party.

So far, three cases of similar nature have come to light and it is under investigation and when the matter came up before this Court earlier, this Court has perused the records and has found that unless the petitioner is secured and interrogated, the crime of forgery and cheating cannot be underrated. Even after lapse of four months, there is no change of circumstances and in fact, the police reports that in this case and other connected cases, they are collecting evidence and if necessary even the defacto complainant herein if found privy to the fraud, forgery and fabrication, will be arrested and final report will be filed.
