Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to Writ of Mandamus, to direct the Respondent herein to waive the interest and allow the Petitioner to pay the deferred tax for the year 1992 to 1997 in installments considering the petitioner's representation dated 26.02.2006 and 06.02.19.

O R D E R

The prayer of the petitioner is for disposal of the petitioner's representation dated 26.02.2006 and 06.02.2019. On 02.011.2020, this Court had recorded that as there is proof of having dispatched the representation dated 06.02.2019. the respondent could proceed to hear the petitioner and pass orders thereupon even prior to the next date of hearing of the writ petition.

2. When the matter is taken up today, Mr.R.Swarnavel, learned Government Advocate appearing for the Commercial Taxes Department would say that the representation has been disposed as early as on 27.08.2019 and a copy of the order has been dispatched to the petitioner. Learned counsel for the petitioner, however, would state that no such order has been received.

3. In the interests of substantial justice, let a copy be served forthwith again upon the petitioner and a copy be supplied to the learned counsel for the petitioner as well for onward transmission to the petitioner. The petitioner, if it is so aggrieved by the aforesaid order, is granted liberty to challenge the same in accordance with law within a period of six (6) weeks from today.
