ORDER

By consent of counsels for both the parties, this petition is disposed of at the admission stage itself.

2. This writ petition has been filed seeking to issue a Writ of Mandamus, directing the respondent to pass order on the appeal submitted by the petitioner dated 30.05.2022, within a time frame fixed by this Court.

3. The petitioner was working as Assistant/ Sales Tax Collection Inspector in the office of the AC(CT), Mannady East Assessment Circle, Chennai. The Department had initiated disciplinary proceedings against the petitioner with regard to the criminal case registered against him under the Prevention of Corruption Act and finally has passed order, dismissing the petitioner from service. Against which the petitioner had preferred an Appeal before the respondent, but it was not disposed till date. Hence the Writ petition.

4. The learned Government Advocate appearing for the respondent submitted that the Appeal filed by the petitioner will be considered by the authorities concerned and appropriate orders will be passed on its own merits.

5. Inview of the above submission and considering the limited scope of prayer and to meet the ends of justice, without expressing any opinion on merits, it is ordered as follows.

i) The respondent is directed to consider the Appeal filed the petitioner dated 30.05.2022 and to pass orders on its own merits and in accordance with law, as early as possible, within a period of twelve weeks from the date of receipt of a copy of this court.

6. With the above direction, this writ petition is disposed of . No costs.
