The instant application has been filed seeking leave of the Court to sue the respondents 1 to 7/defendants, who are placed outside the territorial limits of this Court.

2.In the affidavit filed in support of this application and also in the plaint averment, it is asserted by the applicant/plaintiff that they are engaged in online business and their services are made available to the customers at Chennai through the platform of the defendants, namely "Google Play". It is asserted that the customers who are placed at Chennai access services of the plaintiff's app through the platform of the defendants. The main dispute in the suit is regarding service fee charged by defendants for providing their platform to the app developers like applicant. Since the apps developed by applicant which is loaded in defendant's platform are accessed by customers at Chennai, part of cause of action for the suit arose within the territorial limits of this Court.

3. In view of the said averments, the application in A.No.2786 of 2023 is allowed.

4. Registry is directed to number the suit and list the matter for hearing on 08.06.2023.
