PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the 2nd respondent herein to transfer the case from the 1st respondent to the Central Crime Branch, who are the competent authority and to investigate further and submit a final report within a time frame.

ORDER

The Criminal Original Petition has been filed for a direction to transfer the investigation in Crime No.2303 of 2013, pending on the file of the 1st respondent police.

2. Heard the learned counsel appearing for the petitioner and Mr.Mohammed Riyaz, learned Additional Public Prosecutor appearing for the respondents.

3. The main grievance that has been expressed by the petitioner is that it is a clear case of land grabbing for which an FIR was registered in the year 2013 and till date, there has been absolutely no progress in the investigation and left with no other option, the present Criminal Original Petition has been filed before this Court seeking for appropriate directions. https://hcservices.ecourts.gov.in/hcservices/

4. Taking into consideration the facts and circumstances of the case and the nature of grievance that has been raised in the complaint given by the petitioner, this Court deems it fit to transfer the investigation in Crime No.2303 of 2013, pending on the file of the 1st respondent to the Central Crime Branch, Chennai. The 1st respondent is directed to hand over the entire case records along with any other connected case, if any pending, to the Deputy Commissioner of Central Crime Branch, Chennai, within a period of two weeks from the date of receipt of copy of this order. The Deputy Commissioner of Central Crime Branch, Chennai, shall immediately assign the case for investigation before a team dealing with land grabbing cases. The investigation shall be taken up immediately by the concerned team and shall be completed as expeditiously as possible.

5. This Criminal original Petition is disposed of with the above directions.
