Against this petition, Caveat and supporting affidavit were filed by the Caveators. As per order of this Court, the Original Petition No.571 of 2013 was converted into Testamentary Original Suit No.45 of 2016.

J U D G M E N T

When the matter came up for hearing today, the learned counsel for the plaintiff submitted that as the plaintiff is not intending to proceed with the case, the suit may be dismissed as not pressed and he has also made an endorsement to that effect.

2. In view of the aforesaid submission and endorsement made by the learned counsel for the plaintiff, this Civil Suit is dismissed as not pressed.
