( Criminal Jurisdiction ) Tuesday, the Seventh day of September Two Thousand Twenty One PRESENT The Hon`ble Mr Justice M.DHANDAPANI CRIMINAL MISCELLANEOUS PETITION No.8761 of 2021 IN CRL OP.9018/2021 ASHOKAN [ PETITIONER ] Vs THE STATE REP BY [ RESPONDENT ] THE INSPECTOR OF POLICE, EDF-II, TEAM 3, CENTRAL CRIME BRANCH, CHENNAI (CR.NO.90/2021) Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify the condition imposed in Crl.O.P.No.9018 of 2021 dated 16/06/2021 pending investigation on the file of the respondent police directing the petitioner to deposit a sum of Rs.1,35,00,000/- to the credit of Crime no. 90 of 2021 within 8 weeks from the date of receipt of the order and pass any other order as this Honourable Court may deem fit and thus render justice.
Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.C.D .JOHNSON, Advocate for the petitioner and of M/S. A.GOPINATH, Govt. Advocate ( Crl. Side) on behalf of the Respondents the court made the following order:- This petition has been filed to modify the condition imposed by this Court vide order dated 16.06.2021 in Crl.O.P.No.9018 of 2021, wherein, the petitioner was directed to deposit a sum of Rs.1,35,000/- to the credit of the Crime No.90 of 2021 without prejudice to his defence before the learned CCB of CBCID Court at Egmore.
2. This court granted Anticipatory bail to the petitioner on 16.06.2021 imposing the condition that he should deposit a sum of Rs.1,35,00,000/- (Rupees One Crore Thirty Five Lakhs Only). Since the https://hcservices.ecourts.gov.in/hcservices/
petitioner on his own volition agreed to deposit the said amount and was granted anticipatory bail. However, now the petitioner engaged another Counsel and filed the modification petition to modify the conditions imposed in Crl.OP.No.9018 of 2021 dated 16.06.2021.
3. In view of the above, this Court is of the opinion that the amount imposed by this Court is based on petitioner representation and no interference is required. Accordingly, this Criminal Miscellaneous petition is dismissed.
