The prayer sought for in the present petition is to call for the records in C.C.No.47 of 2017, now pending on the file of the learned Additional Mahila Magistrate at Allikulam And quash the same.
2. It is submitted that, pending Criminal Original Petition, the petitioner and the 2nd respondent/defacto complainant have amicably resolved the dispute between themselves.
3. Both the learned counsel have identified the de-facto complainant, who is present before this Court today. In order to identify the petitioner and the de-facto complainant, they have https://hcservices.ecourts.gov.in/hcservices/
submitted the photo copies of their Aadhar Cards viz., Yokesh Raj Mohan - 448165490620 and Sukanya - 970231455105 and after verification of the original, the same are recorded.
4. Today, an Affidavit dated 12.12.2017 was also filed by the 2nd respondent/defacto complainant to the effect that she has no objection to quash the proceedings in C.C.No.47 of 2017 pending on the file of the learned Additional Mahila Magistrate at Allikulam .
5. The learned counsel for the petitioner handed over the demand draft in D.D.No.00406578 for a sum of Rs.6,50,000/- (Rupees Six Lakh Fifty Thousand only) to the de-facto complainant who, appears party in person before this Court today.
5. Recording the same, the proceedings in C.C.No.47 of 2017 pending on the file of the learned Additional Mahila Magistrate at Allikulam is quashed. The Criminal Original Petition is allowed.
6. The Affidavit filed by the 2nd respondent/defacto complainant dated 12.12.2017 shall form part of the order. Sd/- Asst.Registrar (J) /true copy/ Sub Asst. Registrar nmm To 1.The learned Additional Mahila Magistrate, Allikulam.
