The petitioner herein, being aggrieved by the delay in disposing application filed under Section 156 (3) of Cr.P.C., pending before the Judicial Magistrate No.III, Coimbatore, is before this court seeking 1/4

appropriate direction for speedy disposal of the said petition.

2. The grievance of the petitioner herein is that on 04.05.2023, she has filed petition before the Judicial Magistrate No.III, Coimbatore under Section 156 (3) of Cr.P.C., to take action against the Villagers named in the complaint who threatened her, abused her with filthy language, when she refused to induct them in the village temple Committee.

3. According to the petitioner, the respondent police failed to take action on her complaint and taken a side in favour of the perpetrator of the offence and hence she was forced to approach the Judicial Magistrate exercising right under Section 156 (3). In spite of the pendency of the case for more than one year, the Magistrate has not passed any order. However, called for report from the respondent police, who had already exposed their lopsided investigation.

4. Learned Government Advocate (Crl.Side), on perusal of the records and on instructions, submitted that the learned Magistrate has caused notice to the respondent and called for report in connection with 2/4

the complaint given by this petitioner. The police has submitted its report. The respondent police will act in accordance with the direction of the Judicial Magistrate

5. In the light of the above facts, it is suffice to direct the Judicial Magistrate to expedite the proceedings and pass appropriate order in accordance with law, within a period of 30 days.
