Prayer: Criminal Original Petition filed under Section 438 Cr.P.C., praying to enlarge the petitioners on bail in the event of their arrest by the respondent police in Crime No.3889 of 2020, on the file of the respondent police.

O R D E R

(The case has been heard through video conference) The petitioner who apprehends arrest at the hands of the respondent Police for the offence punishable under Sections 341, 294(b), 324, 506(ii) IPC in Crime No.3889 of 2020, seeks anticipatory bail.

2.The case of the prosecution as per the defacto complainant Suresh is that he is residing at Redhills, Vadakarai and the first accused Karuna is living opposite to his house and the third accused Justin is living in the adjacent house and that the accused used to stand near his house and used to tease his daughters. Therefore, a week before to the occurrence, the defacto complainant had requested A1 Karuna not to sit in front of his house and also requested him not to tease his daughters due to which, on 07.10.2020 the accused had abused and assaulted the defacto complainant with hollow block stones due to which, he sustained injuries on his head. 3.The learned counsel appearing for the petitioners would submit that the petitioners are innocent persons and they have been falsely implicated in this case. 4.The learned Government Advocate (Crl. Side) appearing for the respondent police would vehemently oppose stating that the petitioners have not only teased the daughters of the defacto complainant but also teased young girls in that area and when it was questioned by the defacto complainant, they have assaulted him with hollow block stones due to which, he suffered 20 sutures in the forehead. He would further submit that though the victim is discharged from the hospital, still sensitiveness is prevailing in the locality.

5. It is seen that the petitioners used to tease young girls and when it was questioned by the father of the girls, they have threatened and assaulted him with hollow block stones. Taking into account the nature of offence, this Court is not inclined to grant anticipatory bail to the petitioners. Accordingly, this Criminal Original Petition stands dismissed.
