Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus directing the respondent herein to entertain the petitioners returned Share Auto permit application dated 21.02.2020 and grant the permit in the lapsed share auto permit vacancy with respect to vehicle number TN-30/A-9330, forthwith.

(The case has been heard through video conference) The relief sought for in this writ petition is to direct the respondent to entertain the petitioner's returned Share Auto permit application dated 21.02.2020 and grant the permit in the lapsed Share Auto permit vacancy with respect to vehicle number TN-30/A-9330, forthwith.

2. The learned counsel for the petitioner would submit that the petitioner has re-submitted his Application dated 21.02.2020 for Share Auto permit, before the respondent on 22.04.2021. He would further submit that it is suffice that if the said application is duly considered by the respondent Authority and appropriate orders are passed.

3. The learned Government Advocate appearing for the respondent would fairly submit that the Application dated 21.02.2020 which was re-submitted by the petitioner, before the respondent on 22.04.2021 is pending and the same would be considered by the respondent in accordance with law, within a time frame as stipulated by this Court.

4. Heard the learned counsel on both sides.

Recording the submission made by the learned Government Advocate appearing for the respondent, this Court without expressing any opinion on merits of the case, directs the respondent to consider the petitioner's Application dated 21.02.2020 and pass appropriate orders on merits and in accordance with law, as expeditiously as possible.

6. This Writ Petition is disposed of with the above direction. No costs.
