ORDER

The petitioner, who was arrested and remanded to judicial custody on 06.12.2025 for the offences punishable under Sections 103, 238 & 315 of BNS, 2023 (302, 210 & 404 of IPC) in P.R.C.No.73 of 2025 on the file of Judicial Magistrate No.VI, Puducherry.

2.The allegation against the petitioner is that the petitioner had illegal relationship with the deceased. On 05.12.2025, he requested the deceased to come to his house and when she came there, an altercation was made between them. After escalating the arguments between them, he slapped on her chin. When she fell down, he immediately dragged her inside the premises, sat on her body, strangulated her neck using both hands and committed murder her. Thereafter, he concealed the body in the shadow of a thatched hut by covering it with a white bag and took the body on the deceased two wheeler and threw it on the roadside canal viz., Korkaadu. Subsequently, the two wheeler of the deceased and gold chain were concealed at different places. Hence, the respondent police registered a case against the petitioner and he was arrested and remanded to judicial custody on 06.12.2025.

3. The learned Counsel for the petitioner submitted that the petitioner and the deceased were in a relationship and living together. He further submitted that since charge sheet has also been filed, there is no possibility of tampering the evidence or hampering the investigation. He further submitted that the

petitioner was arrested and remanded to judicial custody on 06.12.2025. He further submitted that the petitioner is ready to co-operate with the investigation. Hence, he prayed for grant of bail to the petitioner.

4. Mr.V.J.Priyadarsana, learned Government Advocate (Criminal Side) appearing for the respondent police, reiterated the prosecution case and submitted that the petitioner is the sole accused. He further submitted that it is a murder case due to an illicit relationship between the petitioner and the deceased. He further submitted that the deceased who aged about 40 years old woman. He further submitted that charge sheet has been filed and the same is yet to be taken on file. Therefore, he strongly opposed to grant bail to the petitioner.

5.Considering the gravity of offence committed by the petitioner; that charge sheet has been filed but the same was not taken on file; if bail is granted to the petitioner, he would tamper the witnesses, this Court is not inclined to grant bail to the petitioner.
